The Bella Vista Village Architectural Control Committee works hard to maintain the high standards we enjoy in Bella Vista Village by enforcing the Covenants, Conditions and Restrictions in order to keep our property values as high as possible and the community attractive and highly desirable . Here are some of the most common issues concerning Village Property Owners. If your question is not answered here, please call the ACC for more information.
Additions to Residences
All new materials are to match the existing residence in every way possible, including the type of windows, type and texture of siding, and paint colors. Roofing materials are to match as close as possible. If roof materials cannot be matched, the ACC recommends re-roofing the entire residence. Samples of paint and siding colors are required.

Addresses
Addresses for properties in Bella Vista Village are assigned by
Benton County 911 Administration. All residences should have proper street address number conspicuously displayed and legible from the street.

Boat Docks
Materials used should match the residence as close as possible. Roofing materials should match the residence when a covered boat dock is installed. The ACC will not permit treated lumber to stand in the lake water, but it may be used as decking and railings. Wood which stands in the water must be heart of redwood or cypress, cedar, etc. The ACC will not permit barrels for floatation. Skirting must be of redwood, cedar, or cypress. Styrofoam must be encapsulated.

Burning
Burning of leaves and/or construction materials in pits is permissible so long as it does not constitute a health hazard and is done in a safe manner. All burning should be supervised at all times.

Carports
Carports must be kept in an uncluttered state at all times. The ACC does not permit the use of tarps or canvas to be hung as a wind and weather barrier on carports. Carports may be enclosed into a garage or room addition provided the materials proposed match the existing residence and the plans are approved by the ACC--a
permit is required. If converting a carport or garage into living space, the application must be accompanied with plans for a separate carport or garage.

Clotheslines
Clotheslines should be located so as to be inconspicuous from the roadways and the neighbors. Clothes should not be allowed to remain out overnight. Clotheslines are not encouraged.

Construction Work Site Policy
Trash Receptacles
Restrictions and Regulations:
- All work sites must have a trash receptacle for the proper disposal of small items of litter. Items such as cans, bottles, candy wrappers, food cartons, Styrofoam cups and other such items, along with smaller building material waste, must be placed in a proper container provided at each job site.
- Larger building materials must be kept in a neat and orderly manner.
- Cut trees, logs, branches, and brush must be disposed of as soon as possible.
- Failure to comply will be cause for any ACC Inspector to automatically red tag a site inspection, which means that no further construction may proceed until the job site is cleaned up and a reinspection performed. The homebuilder will be assessed a $50.00 reinspection fee for each offense.
- A trash receptacle may be a dumpster, a utility trailer, a wire mesh enclosure, or
device as approved by the ACC.
Enforcement:
- All ACC Inspectors will be enforcing the Trash Receptacle Policy.
KEEP THE CONSTRUCTION SITE CLEAN!
Toilet Facilities
Restrictions and Regulations:
- All job sites permitted after September 13, 2004 must have toilet facilities.
- Toilet facilities must be located within the property lines, unless otherwise approved by the ACC.
- Toilet facilities must be on the job site at the time of footing inspection.
- Failure to comply will be cause for any ACC Inspector to automatically red tag a site inspection, which means that no further construction may proceed until a toilet facility is on the site and a reinspection is performed. The home builder will be assessed a $50.00 reinspection fee for each offense.
Enforcement:
- All ACC Inspectors will be enforcing the Toilet Facilities Policy.

Culverts
Culverts under driveways are required where any existing drainage ditch is evident. The size is determined by the volume of water runoff in the ditch. Placing culvert pipe the entire distance of a lot is not permitted without acquiring the approval of POA

Decks
Staining, painting, or weather-sealing of decks is recommended to alleviate sun bleaching, as well as weather rot. Deck additions shall match existing decks with materials and configuration, and be approved by the ACC. Deck railings are required on decks in excess of 30" high, designed so that
the balusters/intermediate rails or ornamental patterns such that a
4-inch-diameter sphere cannot pass through any opening.

Detached Garages
Detached garages, permitted, although not encouraged, must match the residence in all aspects. The determination of allowing a detached garage depends on the lot location, size and contour, septic location and only upon the approval of the ACC. If a detached garage is on an easement, you must get center easement released from CCI.

Dog Runs
A fenced area for pets is acceptable and should be inconspicuously located on the property. Areas should be kept clean at all times and have a concrete or gravel floor. A permit is required and must be approved by the ACC. This includes portable pet enclosures.

Drainage Ditches (Roadside)
The altering of the shape, size, direction of the flow or the volume of the flow, of drainage ditches is not encouraged. Should any altering cause the deterioration of roadways or property, the drainage ditch should be brought back to its original condition. Approval of the ACC and the POA Public Works Department is required prior to landscaping or altering of roadside drainage ditches.

Driveways
Primary driveways should be of a hard substance such as concrete, asphalt, laid brick or stone in concrete, and have an approach apron of cold mix asphalt at the street entrance. A culvert pipe must be in place where a drainage ditch exists, and a 1" PVC pipe for any future wires or cables. A 10' radius at the turn is recommended. Driveway grade will meet street grade.

Fences
Fences are permitted by review and approval of the A.C.C., as to location and height. Wood privacy fences may not exceed 8' in height and Chain Link fences may not exceed 5' in height. Split rail and other decorative type fences may not exceed 4' in height.

Firewood
Firewood should be neatly stacked in an inconspicuous, out-of-sight location. Canvas or tarps may be used so long as it is black or brown, etc. Brightly colored tarps or covers will not be allowed.

Gutters & Downspouts
The installation of gutters and downspouts is encouraged to alleviate ground erosion around the residence at the roof line. Splash blocks should be used, or the use of a drain pipe to a ditch can be used, although the use of a drain pipe could cause problems when it clogs up with leaves. A drain pipe cannot be directed onto another person's property. The color of the drains and downspouts should match the residence.

Heat Pumps - Closed Loop Lake Systems
These systems are permissible and should be installed by qualified installers. The loop, as it enters and exits at the lakeshore, should be buried a minimum of 12" in the silt and shoreline, up to the residence. The cooling tank, which is submerged, should be at least 10' below the water level and secured against floating up. Should a leak ever occur which becomes a danger to the lake or the aquatic life, the system will not be allowed to re-enter the lake without first eliminating the possibility of any further danger.

Improved Lots
Lots which have a residence built upon them must be maintained continuously, such as mowing, weeding, etc.

Residential Landscaping
Any landscaping that alters the natural flow of rain runoff must not alter the flow so that it is forced onto another person's property, but must keep the flow within the drainage easement and culvert ditch. Standard landscaping is encouraged but when retaining walls, sidewalks, fences, etc. are included, a permit is required. Clean up of left over dirt and gravel from the roadways is required.

Painting
Two-tone painting of residences is preferred. It is also required to paint the foundation to match the residence. A permit is required to repaint. There is no fee. Colors are to be approved by the ACC. A color sample is required. No exceptions.

Piers are to be block or poured concrete. The use of wood piers is not permitted.

Propane Tanks

Rental Properties
These properties should be kept in a neat and orderly fashion. Standard maintenance should be ongoing to insure compliance with the covenants. This includes lawns being mowed regularly. Any violation should be brought to the attention of the owner upon notification of a lack of maintenance.

Residential construction sites will comply with all ACC policies and regulations as set forth in the applications. This will include weekly job site cleanup.

Satellite Dishes
Black, open mesh, are preferred, located in the rear or side yard, where applicable. Roof mounted are discouraged. All satellite dishes must be approved by the ACC. Policy has been revised to accommodate 18" dishes.

Seawalls
Treated wood may not be used for seawalls, although heart of redwood, cypress, concrete, stone, etc., may be used. A seawall is required when an existing septic system, through erosion, becomes closer than 80' to the shoreline. It is preferred that seawalls be 18" above spillway. Seawall installations may be required with all new residential permits on lakefront properties. Any exceptions must be approved by the ACC.

Septic Systems
A malfunctioning septic system must be reported immediately to the ACC office. A septic system may not be installed on Common Property unless it is a hardship which such installation cannot be avoided in order to have properly functioning system. Permission to install any portion of a septic system on the Common Property requires the approval of the POA.

Signs
I. No OPEN HOUSE, DIRECTIONAL, GARAGE SALE, FOR SALE or any other signs will be permitted to be erected or maintained on the following without prior approval of the ACC.
- Reserved Properties (by Permission of CCI only)
- Common Properties
- Commercial Properties
- Golf Course Properties
- Private Properties, without first acquiring the property owner's permission.
II. OPEN HOUSE signs will be permitted to be placed and maintained on the following, by approval of the ACC:
- Roadway rights-of-way
- Townhouse roadways, as close to the roads as possible
- On the actual properties for sale
- A property may have a "FOR SALE" or "HOUSE FOR SALE" sign on the premises.
III. OPEN HOUSE and/or GARAGE SALE signs are subject to the following:
- Only one such sign may be displayed on the property which may state "HOME FOR SALE" or "FOR SALE." Etc. Two signs may be permitted on designated GOLF COURSE or LAKE FRONT properties.
- An agent or owner must be present at the time OPEN HOUSE signs are displayed.
- Signs may not remain overnight, except those on premises.
- SOLD SIGNS are not permitted.
- Only one OPEN HOUSE sign to an intersection. If two or more are found, all will be picked up.
- Three OPEN HOUSE directional signs maximum, and only if needed.
- Flags, banners, balloons, etc., are not permitted as sales attention devices.
- Signs cannot exceed three square feet or approximately 27" x 27".
- All signs must be removed from the properties when the property is sold.
- Signs cannot advertise a business or business venture, i.e. sample sale, closeout, arts and crafts, for rent, contractors, banks, etc.
- Signs stating reduced or give-away, etc. are prohibited.
- Prices of properties are not to be displayed.
IV. Any and all signs found in violation, or are found in an unkempt condition, will be picked up and stored at the ACC office for a period of one (1) week.
V. Signs on undeveloped lots for sale, either by owner or realtor, cannot exceed five square feet in area and are to be displayed either by signs or on a tree. Tree displayed signs are to be between four and six feet from ground level and are to be of professional sign quality. Signs are to be removed when property sells. Prices of lots may not be displayed on the properties. Signs stating reduced or give away, etc., are not prohibited.
VI. Signs on properties with residences UNDER CONSTRUCTION are limited to:
- Permit for building
- Builder's sign
- Realtor's sign
- Signs advertising a commercial business are prohibited, i.e. subcontractors, banks, etc.
- NO SIGNS may be attached to the ACC PERMIT BOARD except the permit.
VII. CAMPAIGN SIGNS are limited to a person's property only. One sign per candidate. Signs are not permitted in the rights-of-way or as stated in paragraph I.
VIII. Signs are not permitted to be attached to telephone poles, street signs, stop signs, POA signs, etc. (This regulation includes garage sale, yard sale, weddings, family reunions, lost pet, etc.)
IX. FOR RENT and FOR LEASE SIGNS are not permitted.
X. GARAGE SALE signs must comply with Sections I, II, and III.
XI. No other signs unless approved by the ACC.

Standard Maintenance
This includes, but is not limited to repainting, replacing deck boards, windows, etc., so long as the size, shape, location OR materials are not altered. A permit is required, but these items do not require a fee.

Storage Sheds
Storage sheds must match the existing residence as much as possible. A permit is required and must be approved by the full committee at the regularly scheduled monthly review tour, normally the last Monday of each month.

Stump Dumps
The usage of stump dump is restricted to property owners and/or someone working for a property owner, to dispose of rock, dirt, tree limbs, leaves, branches, etc. NO DUMPING OF TRASH will be permitted. Stump dumps are located on Hampstead Road, Ferrell Road in the Highlands and Trafalgar Road. Manufactured products are not permitted in Bella Vista stump dumps.

Surveys
It is recommended that property owners acquire a valid survey, prior to purchase, or as soon as possible.

Trash Containers
It is not permitted to allow trash containers to remain outdoors, at road's edge, overnight but are to be kept in the carport, garage or other inconspicuous locations except for pickup days.

Vacant Lots (Unimproved Lots)
These areas cannot be used for storage of materials. They cannot be used for the disposal of trash. A boat dock may not be permitted on a vacant lot, unless the owner requesting the boat dock owns the adjacent lot, or the dock cannot or will not be able to be installed on the improved property. Vacant or unimproved lots may be cleared of brush, dead trees, etc., by the owner, so long as the debris is removed and properly disposed of.
